The 49ers activated linebacker Aldon Smith from the non-football injury list on Thursday. He’ll be eligible to play when the team takes on the Panthers at home on Nov. 10.
Smith was placed on the non-football injury list on Sept. 23, just days after being arrested and charged with DUI. He then entered into rehab for counseling for an alcohol problem. His legal issues aren’t settled however, as he turned himself into authorities on Tuesday on felony weapons charges.
Smith was released $75,000 bail.
“Aldon was in the building,” head coach Jim Harbaugh said. “It was great to see the reaction of others who saw him and Aldon’s reaction of being back here with some of the guys. He looks great, and we’re having a great day.”
Smith is due in court on Nov. 12 for the weapons charge. He’s also have to return on Nov. 19 for the DUI issue.
